Welcome to iLean-Pan. These Terms of Service (“Terms”) govern your use of ilean-pan.com (the “Site”) and your purchase and use of products offered through the Site. Throughout these Terms, “iLean-Pan,” “we,” “us,” and “our” refer to iLean-Pan and its owner/operator.

By visiting our Site, placing an order, or purchasing or using an iLean-Pan product, you agree to these Terms. Please read them carefully before using the Site or purchasing a product.

1. ONLINE STORE TERMS

You may use this Site and purchase our products only for lawful purposes. You may not use our products, Site, images, written content, designs, trademarks, or other materials in violation of applicable law or our intellectual property rights.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or inventory errors, unauthorized resale, or misuse of the Site.

2. PRODUCT INFORMATION

We make every effort to describe and display our products accurately. Because products are viewed on different screens and may be manufactured in different production runs, colors, finishes, dimensions, weight, packaging, and other minor details may vary.

The iLean-Pan is designed with a sloped cooking surface that creates different cooking areas within one pan. Cooking performance and temperatures will vary depending on the stove, burner, heat setting, ingredients, cooking method, and placement of food within the pan.

The current iLean-Pan is designed for compatible gas and electric cooking surfaces and is not designed for induction cooking unless a particular product listing expressly states otherwise.

Customers are responsible for reviewing product specifications and compatibility information before purchase and use.

3. SAFE USE

Cookware becomes hot during normal use. Always exercise appropriate care when cooking and handling cookware.

Customers are responsible for following all product instructions and generally accepted kitchen and cooking safety practices, including appropriate supervision around children and pets.

iLean-Pan is not responsible for injury, property damage, or other loss resulting from misuse, overheating, unattended cooking, improper handling, use on an incompatible cooking surface, failure to follow instructions, or use of the product for a purpose for which it was not designed.

4. PRICES AND PAYMENT

Prices are listed in U.S. dollars unless otherwise stated and may change without notice.

Applicable taxes, shipping charges, and other charges will be shown during checkout before the order is completed.

Payment must be successfully processed before an order is fulfilled.

We reserve the right to correct pricing, product-description, inventory, or other errors and, when appropriate, cancel an affected order and issue a refund.

5. SHIPPING

Customers are responsible for shipping charges unless a promotion or product listing expressly states otherwise.

We carefully pack every iLean-Pan order for shipment. Shipping and delivery estimates are estimates only and are not guaranteed unless expressly stated.

Once an order has been transferred to the shipping carrier, circumstances outside our control may affect delivery.

6. RETURNS, REFUNDS AND DAMAGED PRODUCTS

Returns and refunds are governed by the iLean-Pan Return and Refund Policy in effect when your purchase is made.

If your product arrives damaged, defective, or materially different from what you ordered, please contact us promptly and retain the product, packaging, and shipping materials so that we can evaluate the issue.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer protection law.

7. COOKING RESULTS

Recipes, cooking demonstrations, videos, suggested cooking times, temperatures, and other cooking information provided by iLean-Pan are for general informational purposes.

Cooking appliances, ingredients, food thickness, starting temperatures, altitude, cooking techniques, and other conditions vary. Customers are responsible for determining that food has been safely and thoroughly cooked before consumption.

We do not guarantee that a particular recipe, cooking time, temperature, or technique will produce identical results for every user.

8. INTELLECTUAL PROPERTY

The iLean-Pan name, product concept and design, website content, photographs, videos, graphics, written materials, recipes where protectable, logos, branding, product descriptions, and other original materials are owned by or licensed to iLean-Pan and are protected by applicable intellectual-property laws.

The iLean-Pan product is patent pending.

Nothing on this Site grants permission to copy, reproduce, manufacture, modify, distribute, sell, commercially exploit, or create derivative products based upon our proprietary designs or protected materials without prior written permission.

9. REVIEWS AND USER CONTENT

If you submit a product review, photograph, testimonial, recipe, comment, or other content to us, you represent that you have the right to provide that material.

Unless otherwise agreed, you grant iLean-Pan a non-exclusive, royalty-free right to use, reproduce, display, and share submitted content in connection with our business and marketing.

We reserve the right to remove content that is unlawful, abusive, misleading, infringing, or otherwise inappropriate.

10. THIRD-PARTY SERVICES

Our Site may use or link to third-party services, including payment processors, shipping providers, social-media platforms, and other websites.

We are not responsible for the content, policies, availability, or practices of independent third parties. Your use of their services may also be governed by their own terms and policies.

11. DISCLAIMER OF WARRANTIES

Except for any express warranty we provide and any warranty or right that cannot legally be excluded, products and Site content are provided on an “as available” basis.

To the fullest extent permitted by law, we disclaim implied warranties that may otherwise apply, including implied warranties of merchantability or fitness for a particular purpose, except where such disclaimers are prohibited by law.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, iLean-Pan and its owner, affiliates, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or our products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless iLean-Pan and its owner, affiliates, employees, contractors, and representatives from claims arising from your unlawful use of the Site, violation of these Terms, infringement of another party's rights, or misuse of our products.

14. PRIVACY

Your submission of personal information through the Site is governed by our Privacy Policy.

Payment information may be processed by Shopify or other third-party payment processors and is also subject to their applicable terms and privacy practices.

15. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our products, business practices, Site, or applicable requirements.

The version posted on the Site at the time of your transaction will govern that transaction unless otherwise required by law.

16. GOVERNING LAW

These Terms and any dispute arising from your use of the Site or purchase of our products will be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where applicable law requires otherwise.

17. SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies expressly incorporated into them, constitute the agreement governing your use of the Site and purchases from iLean-Pan.
